Privacy Policy of AMEBEATO – ASSOCIAÇÃO DE MORADORES E EMPREENDEDORES DO BEATO
AMEBEATO attaches great importance to the privacy of the Users (Member) of its website and platforms, subscribing the duty to preserve the confidentiality of personal data obtained here or by other means, of other information collected, handled, used and stored about them, whose treatment is presented as a fundamental right.
In compliance with its corporate purpose as determined in the Articles of Association, in the exercise of its activity, its values, principles of action and behaviour, and in compliance with the General Data Protection Regulation (GDPR), adopted and contained in REGULATION (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data, AMEBEATO is committed to ensuring the confidentiality, integrity and availability of the personal data, stored and transacted, structured and unstructured, of its Users (Members), as well as to respecting their privacy.
1.Scope of the AMEBEATO Privacy Policy
The present Privacy Policy covers the personal information that AMEBEATO collects and processes when the Holder (Member) uses its Platforms or Services, namely, any and all information relating to an identified or identifiable natural person, including name, identification number, location data, electronic identifiers, as well as one or more specific elements of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
2.Collection of Personal Data and information of the Users (Members)
AMEBEATO through its Platforms and its administrative services, collects and processes the User’s (Member) personal information to provide him/her a service and, or, for the purposes of disclosure and sharing of information and documents related to its activity, whose definition of values, objectives, promotion and development, in its territorial area of activity and in all its variants, constitute AMEBEATO’s attributions. By registering and accessing the AMEBEATO Platforms, the User (Member) ceases to be anonymous to AMEBEATO. By registering, the User (Member) declares to have been informed explicitly and specifically about the processing, treatment and use of the data and its purpose, expressly consenting to them, as well as being informed that he may, at any time and by an unequivocal act, withdraw such consent. AMEBEATO automatically receives and stores non-sensitive information in its technical records on the computer of the User (Member) when using its Platforms whether or not the User (Member) has created an account or is just browsing the AMEBEATO servers.
AMEBEATO may collect information including, but not limited to, about the Internet browser software of the User (Member), the IP (internet protocol) address that identifies the computer of the User (Member), the AMEBEATO cookie information (connection witnessing), the originating website and the page requested by the User (Member).
AMEBEATO may also collect information about the location of the User (Member) and his online activity on the AMEBEATO Platforms.
AMEBEATO may collect information including, but not limited to, about the Internet browser software of the User (Member), the IP (internet protocol) address that identifies the computer of the User (Member), the AMEBEATO cookie information (connection witnessing), the originating website and the page requested by the User (Member).
AMEBEATO may also collect information about the location of the User (Member) and his online activity on the AMEBEATO Platforms.
3.Purposes of the collection and processing of Personal Data
AMEBEATO uses the collected information to perform the technical management of the AMEBEATO Platforms and for research and development activities aimed at achieving and maintaining a high level of service on its Platforms, personalizing the contents which the User (Member) accesses, contacting the User (Member) and making him/her aware of the availability of new services, as well as for the purposes of performing the procedures for organizing and managing the participation of the User (Member) and Holder of the personal data in AMEBEATO’s activities.
AMEBEATO processes the personal data collected, either by fully or partially automated means, or by non-automated means contained in files or intended for them.
4.Sharing, ceding, disclosing, retaining and subcontracting the processing of Personal Data
AMEBEATO does not sell, cede or make available to third parties, in any way and or for any purpose, the personal information of the User (Member), including, among those, information technology service providers, consultants and any other third parties who perform data processing on behalf of AMEBEATO without the prior and express authorization of the User (Member) and for other reasons that are not in accordance with the purposes for which the information was originally collected, or for other purposes authorized by law.
However, the User (Member) expressly authorizes and agrees to the disclosure of their personal data to third parties where:
The data processing is necessary for third parties, working on behalf of and or for AMEBEATO, to provide a service requested by the User (Member), and those third parties are prohibited from using the personal data provided to them by AMEBEATO for any purpose other than to provide the service requested by and for the User (Member). The processing of data is necessary to comply with a legal obligation to which the responsible is subject, particularly when AMEBEATO is legally required to comply with a court order or provide information to criminal investigation authorities or police, in particular, to perform security checks relating to sites or events to which the User (Member) has requested access. AMEBEATO may allow the personal data to be, totally or partially, processed by subcontracted third parties. The subcontracted third parties are responsible with AMEBEATO under the terms contracted with the same, primarily for compliance with the rules contained in the competent contracts and compliance with the General Regulation on Data Protection, and primarily in matters of confidentiality and security of personal data.
Before disclosing the personal data of the User (Member) to third parties, AMEBEATO ensures that the third parties have adopted adequate and sufficient security and data protection measures regarding confidentiality and security and that they act in an appropriate manner to ensure compliance with these measures, and, where doubts arise as to whether an adequate level of protection is guaranteed, AMEBEATO commits to obtain the prior and express authorization of the User (Member) and, within the scope of its internal audit processes, AMEBEATO commits to perform regular checks on the data processing performed by third parties, especially with regards to the respective security measures. AMEBEATO will not retain personal data longer than necessary for the fulfilment of the intended purposes and the compliance with legal requirements, unless with the express agreement, to the contrary, of the User (Member).
Upon termination of the User (Member) relationship with AMEBEATO, AMEBEATO will delete the data as soon as possible, except where there is a legitimate or legal obligation to keep the relevant records.
5.Rights of the User (Member) to access, update and delete their Personal Data
The User (Member) has the right to request information about the personal data that AMEBEATO collects and processes about him/her. All requests must be made by registered mail, accompanied by proof of identity (copy of official identification document with photo) and refer to the URL of the AMEBEATO Platform and the contact details of the User (Member), namely telephone or mobile phone number and email address, to: AMEBEATO – Associação de Moradores e Empreendedores do Beato, Campo Grande nº 30, 2 D, 1700-093 Lisboa.
The User (Member) may request that incorrect or incomplete personal data associated with him/her be rectified or erased.
The User (Member) may review, correct, update or delete his/her personal information at any time by accessing his/her account on the AMEBEATO Platform where the data was created, or alternatively, he/she may send a formal request by registered mail to the above-mentioned address.
6.Personal Data Security and Cookies
AMEBEATO intends that the Holder of the personal data feels secure when accessing and using its Platforms. To this effect, AMEBEATO warrants that it has defined and implemented the policies and the technical and organizational measures that are adequate and necessary to maintain the security of the personal data, according to the nature of the data processed and the circumstances and purposes of the processing, in order to avoid, considering the available computer technical knowledge, the unauthorized processing, access, alteration or loss of the personal data or, including, the identity theft and phishing practices, in order to guarantee the confidentiality, integrity and availability of the data and the permanent resilience of the systems and services for data processing. AMEBEATO recognizes the User’s (Member) rights to be forgotten or to erasure of data (the holder of personal data is entitled to request that their data be erased), of portability (the holder of personal data may request that the data they have provided to AMEBEATO be transferred to another entity, provided that this is technically possible) and of not being subject to any decision taken solely on the basis of autonomous processing.
AMEBEATO guarantees that within 72 hours will notify the National Commission for Data Protection of all data breaches with risk to the respective User (Member) / Data Subject. AMEBEATO may install and access AMEBEATO’s cookies on the computer or any device of the User (Member), being that a cookie file is a small set of data that often includes an anonymous unique identifier that is sent to the User’s (Member) browser from a site computer and then stored on the hard drive of the User’s (Member) computer and that the latter, when using the AMEBEATO Platforms, authorizes the use of such cookies, namely, to access the User’s (Member) information when he/she, in turn, accesses the AMEBEATO Platforms so that personalized content may be provided to him/her, track his/her preferences while using the AMEBEATO Services, collect information on his/her browsing habits when not accessing the AMEBEATO Platforms and for research and development purposes aimed at improving the content and services provided by the AMEBEATO Platforms.
7.Children’s privacy
AMEBEATO is especially concerned with protecting the personal data of children and adolescents, therefore the AMEBEATO Platforms and their contents are not intended for children under 13 years of age.
If the adolescent is under the age of 16, the processing of their personal data is only lawful if and to the extent that consent is given or authorised by the holders of parental responsibilities of the child.
AMEBEATO will not intentionally collect any personal data from children under the age of 13, nor from minors between the ages of 13 and 16 without parental consent, nor will it intentionally allow such persons to register as Users (Members). Should the holders of parental responsibilities of the child become aware that their child under the age of sixteen (16) has provided AMEBEATO with personal data without their consent, they shall delete their account, and should AMEBEATO become aware that a child under the age of 13 or a child between the ages of 13 and 16 but without parental consent has provided AMEBEATO with personal data, this information will be deleted as soon as possible and the User (Member) will immediately no longer have access to the Site.
8.Proof of compliance with the rules of processing and free movement of personal data – Accountability
AMEBEATO ensures the proof that the personal data in its possession are legitimate, limited to what is necessary, and are updated, secure and confidential. AMEBEATO ensures the demonstration that it follows policies, procedures, codes of conduct and internal instructions capable of being made available to supervisory entities and that it has the necessary systems to monitor the implementation of such policies and procedures.
9.Data Protection Officer (DPO)
AMEBEATO, responsible for the processing of personal data on its Platforms, and the respective subcontractor, whenever it exists, undertake to appoint a Data Protection Officer, responsible for informing, advising and monitoring the data controller and the respective subcontractor, whenever it exists, as well as the employees handling the data, to respect their obligations concerning the protection of personal data, including the allocation of responsibilities, the awareness and training of staff involved in data processing operations and the performance of the necessary audits, cooperating with the supervisory authority, taking due account of the risks associated with the processing operations, the nature, scope, context and purposes of such processing.
(Member) Users and data subjects may contact the Data Protection Officer on all matters concerning the processing of their personal data and the exercise of the rights conferred upon them.
The Data Protection Officer shall be bound by an obligation of secrecy or confidentiality in the exercise of his or her duties.
10.Amendments to the AMEBEATO Privacy Policy
The User (Member) may consult at any time the present Privacy Policy, available in the AMEBEATO Platforms.
AMEBEATO reserves the right to make changes to the present Privacy Policy at any time and without prior notice.
Whenever subject to changes, AMEBEATO will publish the updated version of its Privacy Policy in this page and other AMEBEATO Internet Platforms, being the User (Member) responsible for regularly consulting the AMEBEATO Privacy Policy. Data Protection – Declaration
By joining and filling in the Membership Application Form, you convey your consent on data protection and authorize AMEBEATO – Associação de Moradores e Empreendedores do Beato to process your personal data of identification and contact, such as name, civil identification number, address, telephone, e-mail, for the purposes of organization management and operation and dissemination of the activity of AMEBEATO, in compliance with the applicable legal and regulatory obligations, and without the availability of which AMEBEATO will not be able to correspond to the requests of the associate within the scope of the exercise of rights and fulfillment of duties emerging from the relationship already established or to be established. Thus, in accordance with AMEBEATO Privacy Policy is informed about how to exercise the rights to information, rectification, erasure, limitation of treatment, opposition and portability of personal data, as well as the right to complain.
